These Terms & Conditions govern your access to and use of the KULTURA website (kultura-mag.eu) and the editorial services we offer through it, including open calls, submissions, participation fees, and the publication of artists' work in our printed editions. By using this site or submitting work, you agree to these Terms in full.

01. Acceptance of these Terms

By accessing this website, creating an artist account, submitting work, or making a payment to KULTURA, you confirm that you have read, understood, and agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the site or submit work.

02. About KULTURA

03. Eligibility

To submit work, you must be at least 18 years old and based in Europe (a resident of a country in the geographic region of Europe). You must be the sole author of the work, or be authorised by all co-authors to submit it on their behalf. By submitting, you confirm that you meet these conditions.

04. Artist account login

We authenticate artists using passwordless login links sent to the address used in your submission. You are responsible for keeping access to that email account secure. Login links expire after a short time and can only be used once. We are not liable for unauthorised access resulting from your own email being compromised.

05. Submissions and your content

When you submit work, you grant KULTURA the right to view, store, internally circulate, and editorially evaluate that work for the purposes of curatorial review. You retain full copyright and all moral rights in the work you submit. If your work is selected and you agree to participate, you grant KULTURA a non-exclusive, worldwide license to reproduce, layout, print, distribute, and promote the submitted work as part of the relevant KULTURA edition and in marketing materials directly related to that edition. You may use the work freely elsewhere.

06. Intellectual property

All editorial choices, design, typesetting, the KULTURA name, logo, and the structure of this website are the intellectual property of KULTURA and protected by copyright and trademark law. You may not copy, reproduce, or republish any KULTURA content (other than your own submitted work) without prior written permission.

07. Participation fees, payments, and refunds

Selection for an edition is followed by a participation offer that includes a participation fee. Fees are charged through Stripe and are payable in [CURRENCY]. Fees cover the editorial production costs associated with including your work in a printed edition. Refund policy: participation fees are refundable within [REFUND_WINDOW_DAYS] days of payment, provided that production for the edition has not yet begun. Once typesetting or print preparation has started, fees are non-refundable. Refund requests must be sent to info@kultura-mag.eu.

08. Selection and editorial decisions

Selection for a KULTURA edition is at our sole editorial discretion. We are under no obligation to publish any submission, to provide individual feedback on rejected work, or to explain our editorial reasoning. Submitting work does not create any expectation of publication.

09. Prohibited content

You may not submit work that: (a) infringes the copyright, trademark, or moral rights of any third party; (b) was generated wholly or substantially by an artificial intelligence system; (c) depicts illegal acts, sexual content involving minors, or incitement to violence or hatred; (d) contains malicious code, viruses, or content designed to harm the site or other users. We reserve the right to remove any submission that violates these rules and to bar repeat offenders from future calls.

10. Liability and disclaimers

The website and the editorial review process are provided "as is" and "as available". KULTURA does not warrant uninterrupted access, freedom from errors, or that the site will be free of vulnerabilities. To the maximum extent permitted by law, KULTURA's total liability arising out of or relating to your use of the site or participation in an edition is limited to the amount of participation fees you actually paid to KULTURA in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top of this page. Material changes will be communicated by email to artists with an active account where reasonably possible. Continued use of the site after a change constitutes acceptance of the updated Terms.

12. Governing law, jurisdiction, and contact

These Terms are governed by the laws of [JURISDICTION]. Any dispute arising from these Terms or your use of KULTURA will be subject to the exclusive jurisdiction of the courts of [COURT_LOCATION], without prejudice to mandatory consumer-protection rights you may have under the law of your country of residence.
